POLICIES AND BUSINESS ETHICS

Business Ethics ensures that all members of the organization act in accordance with the fundamental values of PGA. Failure to adhere to PGA's high moral standards may serve as grounds for exclusion from the Organization.

All individuals associated with PGA who work in the Government of Ukraine (all branches of power), local government bodies, or those persons who have been elected by the people of Ukraine or appointed to positions where they represent public interests (for example, as a Member of Parliament or head of a state-owned company) are obliged to adhere to the following standards of professional conduct:

Compliance with the law:

  1. Individuals associated with PGA are obliged to comply with all laws, rules, and statutes governing their activities. If ambiguous or subjective interpretation is possible, they must interpret them in a manner that imposes the strictest limitations on themselves.
  2. Individuals associated with PGA must not knowingly participate in or facilitate, and must avoid, any violations of laws, rules, and statutes.
  3. Individuals associated with PGA are obliged to prevent violations of the law by other public officials, always disclose information about known violations, and never conceal actual or probable violations by their colleagues, superiors, or subordinates (anonymous reporting).

Professional integrity:

  1. Individuals associated with PGA must not engage in any professional activity involving dishonesty, fraud, blackmail, or deceit, nor undertake any actions that negatively impact their reputation, integrity, or competence.
  2. Individuals associated with PGA are obliged to refrain from accepting or soliciting any gifts or other material or non-material benefits (including honors, degrees, awards) that may compromise the independence and objectivity of the individuals.
  3. Individuals associated with PGA must not use public positions, resources, or information that become available to them while acting in an official capacity for their own benefit or the benefit of any related persons (family, business partners, friends).

Conflict of interest:

  1. Individuals associated with PGA are obliged to make full and fair disclosure of all matters that could reasonably impair the independence and objectivity of the individuals or interfere with their corresponding public duties, to ensure that such disclosures are conspicuous, delivered in plain language, and effectively communicate the relevant information.

Duties to the public:

  1. Individuals associated with PGA are obliged to act in the interest of society and place the interests of the public above the interests of the government, individual state bodies, individual public officials, or their own.
  2. Individuals associated with PGA are obliged to treat all individuals fairly and objectively, without granting anyone preferential treatment or imposing any restrictions not provided by law.
  3. Individuals associated with PGA are obliged to communicate with the public in a direct and clear manner to avoid templates, evasions, and circumvention of the issue.

Specific duties of individuals associated with PGA employed in central or local government bodies:

  1. Individuals associated with PGA must not deprive their employer of the benefits of their knowledge, skills, abilities, experience and are obliged to act in the interest of their employer.
  2. Individuals associated with PGA must not make any unauthorized acts or promises intended to bind their employer.
  3. Individuals associated with PGA must not accept any other paid work, except when explicitly permitted and after obtaining written consent from their employer.
  4. Individuals associated with PGA are obliged to use their working time, employer’s property, authority, and access to information exclusively for the performance of official duties, with due diligence and care.
  5. Individuals associated with PGA are obliged to keep all information known to them that is not public while performing their duties confidential, unless its disclosure is required by law.

Specific duties of individuals associated with PGA elected to act as representatives of the public (i.e., deputies):

  1. Individuals associated with PGA undertake to fulfill the duties for which they received their mandate from the public.
  2. Individuals associated with PGA undertake to make honest efforts to fulfill all promises made during elections or the election campaign and must not substantially deviate from their promises in their actions.
  3. Individuals associated with PGA must not engage in external employment or activities that contradict their mandate.

Specific duties of individuals associated with PGA who act as contractual representatives of the public interest (i.e., independent directors of state-owned enterprises):

  1. Individuals associated with PGA undertake to perform their duties with prudence, diligence, and care.
  2. Individuals associated with PGA are obliged to make honest efforts to ensure objective integrity in the primary interests of the public and must not act in the interests of the individual or organization that appointed them to the position.
  3. Individuals associated with PGA must devote sufficient time and attention to making well-founded and balanced decisions when representing the public interest.
